Terms of Use

By accessing or using evlefoundation.org (the "Site"), you agree to these Terms of Use. If you do not agree, do not use the Site.

1. Use of the Site

The Site is provided for informational purposes and to facilitate donations, volunteer and partnership inquiries, newsletter sign-up, and — once enabled — public comments on blog posts. You agree to use the Site only for lawful purposes, and not to interfere with its operation, attempt unauthorized access, or use automated means to extract data from the Site without permission.

2. User-Generated Content (Comments)

Once a comments feature is enabled: by submitting a comment, you grant the Foundation a non-exclusive, royalty-free, worldwide license to display, reproduce, and moderate that content in connection with operating the Site. You represent that you have the right to post the content submitted and that it does not infringe the rights of any third party.

Prohibited comment content includes, without limitation: unlawful, defamatory, harassing, or threatening material; content that discloses another person's private information without consent; spam or commercial solicitation; and content infringing intellectual property rights. The Foundation reserves the right, but assumes no obligation, to monitor, edit, or remove any comment at its sole discretion, and to suspend or terminate a user's ability to comment.

3. Copyright Complaints (DMCA)

If you believe content on the Site — including a user-submitted comment — infringes your copyright, send a written notice identifying the copyrighted work, the infringing material and its location on the Site, and your contact information, to the Foundation at info@evlefoundation.org. The Foundation will respond to properly submitted notices consistent with the Digital Millennium Copyright Act. Before the comments feature launches, the Foundation should register a designated agent with the U.S. Copyright Office's DMCA Designated Agent Directory to preserve the Site's safe-harbor protection for user-submitted content.

4. Intellectual Property

All content on the Site — including text, images, the Foundation's name and logo, and design elements — is the property of the Edward & Vienna Le Foundation or its licensors and may not be copied, reproduced, or used without prior written permission, except as permitted for personal, non-commercial use.

5. Donations

Donations made through the Site are processed by a third-party payment processor. The Foundation is not responsible for errors, outages, or security incidents arising from that processor's systems. All donations are voluntary; see the Foundation's Gift/Donation Policy for information on corrections and the use of gifts.

6. No Warranty

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including as to accuracy, completeness, or uninterrupted availability of content or any Site feature.

7. Limitation of Liability

To the fullest extent permitted by law, the Edward & Vienna Le Foundation shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of the Site, including content posted by other users.

8. Indemnification

You agree to indemnify and hold harmless the Edward & Vienna Le Foundation from any claim arising from your use of the Site or violation of these Terms, including any content you submit.

9. Governing Law and Venue

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

10. Changes to These Terms

The Foundation may revise these Terms at any time, including to reflect new Site features. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

11. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
