Privacy Policy

The Edward & Vienna Le Foundation ("the Foundation," "we," "our," or "us") respects the privacy of visitors to evlefoundation.org (the "Site"), and of the Foundation's donors, volunteers, and partners. This Privacy Policy explains what information is collected through the Site's current features — contact forms, donation processing, and newsletter sign-up — and future features, including blog comments, as they are added. This Policy will be updated as new features go live rather than left to cover them by implication.

1. Information Collected

  • Provided directly: name and email address submitted through the contact form, volunteer or partnership inquiries, or newsletter sign-up; payment information submitted through the donation form, processed through the Site's Squarespace-based payment integration (Stripe and/or PayPal, as enabled for donations) — the Foundation does not directly receive or store full card numbers.

  • Collected automatically: IP address, browser and device type, referring page, and pages visited, through standard server logs and Squarespace's built-in analytics tools.

  • Platform and hosting: the Site is built and hosted on Squarespace, Inc.'s platform, which provides the underlying hosting, e-commerce, and email-delivery infrastructure and processes certain information as the Foundation's service provider, consistent with Squarespace's own privacy practices, available at squarespace.com/privacy-policy.

  • Cookies and similar technologies: the Site uses cookies necessary for its operation (such as maintaining a donation session) and Squarespace's built-in analytics cookies to understand aggregate visitor traffic. The Site does not currently use third-party advertising or retargeting cookies; this Policy will be updated if that changes.

  • User-generated content (future feature): once enabled, any information submitted in a blog comment, including the name, email address, and any content voluntarily included in the comment itself. Comment email addresses are not displayed publicly but may be visible to the Foundation for moderation purposes.

2. How Information Is Used

The Foundation uses collected information to: process donations and issue tax-compliant receipts; respond to contact, volunteer, and partnership inquiries; send newsletter and update communications to those who have subscribed; operate, secure, and improve the Site, including any comments feature; and comply with applicable legal, tax, and financial reporting obligations.

3. Email Communications

Newsletter and fundraising emails from the Foundation are sent only to individuals who have opted in, using Squarespace's built-in Email Campaigns tool, and comply with the federal CAN-SPAM Act: every email identifies the Foundation as the sender with accurate header information, uses non-deceptive subject lines, is clearly identifiable as coming from the Foundation, includes the Foundation's physical mailing address, and provides a working unsubscribe mechanism. Opt-out requests are honored within 10 business days.

4. Blog Comments and User-Generated Content

If and when a comments feature is enabled on the blog: comments are public by design, and anything posted may be viewed by any Site visitor — do not include sensitive personal information in a comment. The Foundation reserves the right to moderate, edit, or remove any comment at its discretion, including comments containing personal information about third parties, harassment, spam, or unlawful content. IP addresses associated with comments may be retained for spam and abuse prevention. See also the User-Generated Content and DMCA sections of the Terms of Use.

5. Sharing of Information

The Foundation does not sell, rent, or trade personal information. Information may be shared with: service providers performing functions on the Foundation's behalf (Squarespace, for hosting, payment processing, and email delivery; comment moderation tools, once in use), each contractually limited to using the information only for that purpose; and government or regulatory authorities where required by law, subpoena, or in connection with a legal proceeding.

6. Donor Privacy

Donor information is not sold, rented, or shared with third parties for their own marketing purposes. Donors may request to remain anonymous in any public acknowledgment and may opt out of further communications at any time by contacting info@evlefoundation.org.

7. State Privacy Law Disclosures

  • Nevada (NRS 603A): Nevada residents may submit a request to opt out of any sale of covered information by contacting info@evlefoundation.org. As a matter of policy, the Foundation does not sell personal information collected through the Site.

  • California: nonprofit organizations are generally exempt from the CCPA/CPRA, which applies to entities operated for the profit of shareholders or owners. This Policy nonetheless extends the access, correction, and deletion rights described above to California residents as a matter of practice.

  • Colorado, and other states as thresholds are met: Colorado's privacy law does not include a blanket nonprofit exemption. It currently applies only to organizations that control or process the personal data of a significant number of state residents annually — volumes the Foundation does not currently meet, but this section will be revisited as the Foundation's reach grows, particularly through the newsletter and donation features.

  • Other states: several states (including Connecticut, Utah, Indiana, and Tennessee) exempt organizations with the Foundation's 501(c)(3) status from their comprehensive privacy laws. Where a state law does not exempt the Foundation and its thresholds are met, this Policy will be updated accordingly.

8. Children's Privacy

The Site is not directed to children under 13, and the Foundation does not knowingly collect personal information from children under 13, whether through donation forms, contact forms, newsletter sign-up, or comments. A parent or guardian who believes a child has submitted information to the Foundation may contact info@evlefoundation.org to request its removal.

9. Data Security

The Foundation uses reasonable administrative and technical safeguards appropriate to the information collected, including the security measures built into the Squarespace platform. No method of transmission or storage is completely secure, and the Foundation cannot guarantee absolute security.

10. Data Retention

Information is retained only as long as reasonably necessary for the purposes described in this Policy, or as required by law — for example, donation records retained for tax and accounting purposes consistent with IRS recordkeeping requirements.

11. Your Rights and Choices

You may request access to, correction of, or deletion of your personal information, or opt out of newsletter communications, by contacting info@evlefoundation.org.

12. International Visitors

The Site may be accessed from outside the United States, including by supporters connected to the Foundation's outreach work abroad. Information submitted through the Site is collected and processed in the United States, which may not offer the same data protection standards as a visitor's home country.

13. Third-Party Links

The Site may link to third-party websites, including the Foundation's payment processor and social media pages. The Foundation is not responsible for the privacy practices of those third-party sites.

14. Changes to This Policy

This Policy will be updated as the Site's features change, including at the launch of any comments function or other new interactive tool. The effective date above reflects the most recent revision.
